ABSTRACT
The article explores issues concerning the global warming exclusions on directors and officers (D&O) liability insurance. Most D&O policies contain broad pollution exclusions which would apply if directors and officers were sued for failing to disclose their business' climate change risks. It is unknown what impact the U.S. Environmental Protection Agency's position that the greenhouse gas carbon dioxide is not a pollutant will have on the pollution exclusions.
