ABSTRACT
The article discusses the Endangered Species Act of 1973 (ESA), which was enacted by the U.S. Congress to fight species extinction and implement programs for the protection of endangered species. It provides an overview of the Act. Section 7 of the ESA imposes a no jeopardy obligation on federal agencies. The decision in the case National Association of Home Builders v. Defenders of Wildlife reportedly created an exception to Section 7 of the ESA.
