ABSTRACT
The article focuses on the U.S. immigration law, highlighting the scope and purpose of the new R2P doctrine in the country. It provides a conceptual framework to determine whether the doctrine has reached the level of customary internal law or is simply an existing norm within the international legal community. It reveals that the new R2P doctrine is rooted in human rights and international humanitarian law, embracing the victims' perspective and interests.
