ABSTRACT
This article discusses Ukraine's admission into the Council of Europe, highlighting its difficulties complying with Article Five of the European Convention for the Protection of Human Rights and Fundamental Freedoms (ECHR). Topics include a survey of Ukrainian case law heard by the European Court of Human Rights, the Council of Europe's concern over Ukraine's lack of a civil code and code of civil procedure, and conflicts between the procuratura, a Soviet legal institution, and ECHR compliance.
