ABSTRACT
The article focuses on the Australian court case Orcher v Bowcliff Pty Ltd [2012] NSWSC 1088 in which the law on the liability of hoteliers for criminal assaults on guests was reviewed. It informs that in Modbury Triangle Shopping Centre v Ansel 2, a court held that the duty of an occupier does not involve taking reasonable care to prevent physical injury to a person due to criminal behavior of third parties on their land.
